Notice of Privacy Practices (HIPAA)
How your Protected Health Information is collected, used, and safeguarded under federal HIPAA law.
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY. Pursuant to 45 CFR §164.520(c)(3)(i), this notice is electronically available on this website to all patients and the general public.
1. Our Legal Duties
We are required by law to maintain the privacy of your Protected Health Information (PHI), to provide you with this Notice of our legal duties and privacy practices, and to notify you promptly in the event of a breach of your unsecured health information. We must follow the privacy practices described in this Notice while it is in effect.
2. Uses and Disclosures for Treatment, Payment, and Health Care Operations
We may use and share your health information to:
- Treatment: Provide, coordinate, and manage your outpatient psychiatric evaluation and medication management (for example, transmitting an electronic prescription to your designated pharmacy or consulting with an authorized health provider).
- Payment: Bill and process claims with your participating commercial health insurance plan.
- Health Care Operations: Conduct quality improvement, clinical reviews, licensing audits, and overall administration of our practice.
3. Other Permitted or Required Uses and Disclosures
We may disclose your health information without your written authorization only as permitted or required by federal or state law, including:
Preventing serious and imminent threats to health or safety (prevention of self-harm or harm to others).
Complying with mandatory legal processes or valid court orders.
Reporting child, elder, or vulnerable adult abuse, neglect, or exploitation as mandated by state law.
Public health and health oversight activities as required by law.
4. Uses Requiring Your Written Authorization
Other uses and disclosures not described in this Notice will be made ONLY with your written authorization. Specifically:
- Psychotherapy notes (if maintained separately) are never disclosed without your prior written authorization.
- We will never sell your health information or use it for commercial marketing.
- You may revoke any written authorization in writing at any time for future disclosures.

"Confidentiality and transparency are not merely regulatory requirements; they are the foundation of trust and emotional relief."
5. Substance Use Disorder Treatment Records (42 CFR Part 2)
If we receive or maintain records from substance use disorder treatment programs protected under 42 CFR Part 2, those records receive heightened federal protection and will not be used or disclosed in criminal or civil proceedings against the patient without specific written consent or an appropriate federal court order.
6. Your Rights Regarding Your Health Information
Under HIPAA, you have the following rights regarding your health information:
You may submit a written request to inspect or obtain a copy of your health records in electronic or paper format. We will respond within 30 days. Any fee is limited to reasonable, cost-based expenses for supplies and labor permitted under HIPAA. If you ask to receive your records by regular (unencrypted) email, we will explain the risks and send them that way if you confirm your choice. You may also direct us, in a signed written request, to send a copy to another designated person.
You may ask us to restrict how we use or share your information for treatment, payment, or operations. We are not required to agree to discretionary restrictions, EXCEPT that we must agree not to disclose information to your health plan for payment or operations regarding services you paid for entirely out of pocket, unless disclosure is required by law.
You may request that we contact you by specific means or at an alternate location. We will accommodate all reasonable requests.
You may request in writing an amendment to information you believe is inaccurate or incomplete. If we deny your request, we will provide a written explanation.
You may request a list of disclosures made in the past 6 years, excluding disclosures for treatment, payment, operations, or those you explicitly authorized.
You are entitled to receive a paper copy of this Notice upon request, even if you previously agreed to receive it electronically.

7. Secure Platform & Electronic Communications
All telepsychiatry sessions are conducted through secure telehealth platforms with end-to-end encryption complying strictly with HIPAA standards. By submitting contact forms, you explicitly consent to receive clinical communications, appointment reminders, and secure emails regarding your mental health care. Opting out of messages is requested in writing, via the secure messaging platform, by email, or through the website form; if received through other means (such as a STOP reply or phone call), it is also honored and documented in writing.
8. Additional Rights Depending on Your State
In addition to the rights HIPAA grants across all five states, the laws of some states grant further rights over personal data you provide outside an established clinical relationship — for example, when you write to us through the contact form:
- Oregon and Delaware: access that data, correct it, request its deletion, and learn with whom it was shared.
Washington: see our Consumer Health Data Privacy Policy (/consumer-health-data), published as an independent document under the My Health My Data Act (chapter 19.373 RCW).
View Consumer Health Data Privacy Policy (WA)- To exercise any of these rights, write to mentalhealth@oasismentalcare.info. We will respond within the timeframes set by your state's law.
